04/28/99 - The Alabama House has passed HB 104. Now it is off to the senate...SB191.

04/27/99 - HB 104 is moving along. This bill would enact and regulate deferred presentment/check cashing services. The senate version of the bill SB 191 also has been introduced.

04/30/98 - HB 139 did not pass and will be reintroduced in February next year.  It appears as though legal action is being directed at the industry with no protection via statute.  3 plaintiffs have filed a class action lawsuit against 7 defendents in Huntsville. The Alabama Check Cashers Association has not entered the suit on behalf of the defendents because some of the activities of the defendents do not represent the activities of the general membership.  The association is interested in having the lawsuit decertified as a class action on the grounds that the defendents do not act as a class and in fact operate in very different ways.  The association needs your support to engage legal council to get the legislation effort together for the next special session and to decertify the lawsuit.  If you are interested in joining the Alabama Check Cashers Association or helping out in some way, please call Don Carter, President (205)442-5258.

04/22/98 - HB 139 is scheduled behind some other bills and there is some concern that it may not make it through this year's legislation because there are only a few legislative days left. There has been a motion for class action applied for in Huntsville regarding late fees. If the legislation does not pass, the validity of the class action will be determined in court.  House Bill 139 was originally introduced by the Alabama Check Cashers Association but at some point was taken over by the Banking Committee. Some Pawn Brokers opposed the bill because it raised fees for licensing and stated that any other activities other than pawn, and sales of merchandise that came out of pawn, had to be specifically approved by the Banking Commission which places the pawn industry under more strict regulation of the Banking Commission.  A Pawn Broker license in AL currently is $100.  HB139 increased that fee to $500 for a pawn license (if deferred deposit check cashing serivces were offerred) and $100/day for audits.
